Decree No. 318/2025/ND-CP detailing certain provisions of the employment law on labor registration and the labor market information system
On December 12, 2025, the Government issued Decree No. 318/2025/ND-CP, detailing certain provisions of the 2025 Employment Law on labor registration and the labor market information system.
Talentnet would like to summarize the key points related to human resources and payroll as follows:
1. 03 groups eligible for labor registration are as follows:
- Employees subject to compulsory social insurance as prescribed in clause 1, Article 2 of the 2024 Social Insurance Law.
- Employees who are employed but not subject to compulsory social insurance.
- Unemployed individuals are those who are currently jobless, searching for employment, and ready to work.
2. Regulations on labor registration information: Labor registration information includes 5 main groups:
- Basic information of the employee: full name, personal identification number, date of birth, gender, ethnicity, and place of residence.
- Education and certification information: general education level, vocational/tertiary education, national vocational skill certificates, and other relevant certificates.
- Employment and job demand information: current job, employer information, unemployment status (if any), and desired job requirements.
- Insurance information: status of participation and entitlement to social and unemployment insurance.
- Information on specific characteristics: individuals with disabilities, poor or near-poor households, persons with meritorious service to the revolution, and those who have completed military or police service.
In light of this new Decree, Talentnet recommends that Valued Clients pay attention to labor registration to ensure full compliance with current regulations.
On October 30, 2025, the Government issued Decree No. 282/2025/ND-CP regulating administrative penalties in the fields of security, order, social safety; prevention of social evils; and prevention of domestic violence.
Decree No. 282/2025/ND-CP adjusts the penalty levels for various violations, including those related to immigration management. In particular, it increases the fine to between VND 15 million and VND 20 million for foreigners working or operating in Vietnam without a valid permit, or for overstays of 60 to 90 days.
Important Labour Regulations From 2026
Talentnet would like to provide you with some key updates regarding HR and payroll starting from 2026 as follows:
1. Increase in personal and dependent deductions effective 1 January 2026. The personal deduction will be increased to VND 15,5 million per month, and the deduction for each dependent will be VND 6,2 million per month.
2. Increase in regional monthly minimum wages for employees working for employers by region, effective from January 1, 2026. Under this adjustment, the monthly minimum wages (VND/month) are as follows: Region I: 5.310.000; Region II: 4,730,000; Region III: 4,140,000; and Region IV: 3,700,000.
3. The retirement age roadmap for employees under normal working conditions in 2026 will change as follows: 61 years and 6 months for male employees and 57 years for female employees.
